Rackmount.IT Not for Resale (NFR) Program

1. Purpose
The Rackmount.IT Not For Resale ("NFR") Program enables eligible applicants to receive complimentary Rackmount.IT rack mount kits for evaluation, demonstration, and project validation purposes, subject to these Terms & Conditions.
2. Eligibility
The NFR Program is open to end users, resellers, distributors, technology vendors, and other business partners, subject to approval by Rackmount.IT.
3. Application Process
All requests must be submitted via the official Rackmount.IT NFR request form. Submission does not guarantee approval. Rackmount.IT may request additional information at its discretion.
4. Qualification Criteria
4.1 Automatic Qualification
Requests linked to projects involving 50 units or more automatically qualify, subject to verification.
4.2 Discretionary Approval
Requests involving fewer than 50 units are subject to review and may be approved or denied at the sole discretion of Rackmount.IT.
4.3 Rackmount.IT reserves the right to approve, reject, or limit any request based on business considerations and product availability.
5. Use Restrictions
NFR products are provided strictly for evaluation, demonstration, proof-of-concept, and project validation. Products may not be resold, leased, or commercially distributed.
6. Program Limitations
Approval is subject to availability. Rackmount.IT may limit quantities and reserves the right to modify or discontinue the program at any time.
7. Misuse
Misuse of the NFR Program may result in disqualification, revocation of approvals, and potential legal action.
8. Liability
NFR products are provided "as is" without warranties to the fullest extent permitted by law. Rackmount.IT shall not be liable for indirect or consequential damages.
9. Data Protection and Privacy (Global)
Rackmount.IT processes personal data in accordance with applicable data protection laws across all operating regions.
9.1 EMEA (GDPR)
Processing is conducted in compliance with the General Data Protection Regulation (EU) 2016/679 (GDPR), including lawful basis under Article 6 (consent and/or legitimate interest), data minimization, and data subject rights.
9.2 United States (Texas and applicable federal laws)
Personal data is handled in accordance with applicable U.S. privacy laws, including state-level requirements where applicable. By submitting a request, applicants consent to business communications related to their request.
9.3 Canada (CASL & PIPEDA)
Rackmount.IT complies with the Canadian Anti-Spam Legislation (CASL) and Personal Information Protection and Electronic Documents Act (PIPEDA). Express consent is obtained for commercial electronic communications, including clear identification and unsubscribe mechanisms.
9.4 Asia-Pacific (APAC)
Rackmount.IT complies with applicable APAC data protection laws, including but not limited to the Singapore PDPA, Australia Privacy Act, and Japan APPI. Personal data is collected for specified purposes and protected with appropriate safeguards.
9.5 General Principles
Across all regions, Rackmount.IT ensures that personal data is:

9.6 Data Subject Rights
Where applicable, individuals may request access, correction, deletion, or restriction of their personal data and may withdraw consent at any time via sales@rackmount.it.
10. Consent to Communication
By submitting an NFR request form, the applicant expressly consents to being contacted by Rackmount.IT via email and/or telephone regarding their request and related business opportunities, in accordance with applicable laws.
11. Governing Law and Jurisdiction
Any legal matters, disputes, or claims arising from the NFR Program shall be governed by the laws of the jurisdiction where the NFR product is requested and delivered, as follows:

Each party agrees to submit to the exclusive jurisdiction of the courts in the applicable region.
